Lush competition terms and conditions

1.1 In order to enter this competition, email your photograph to competitions@ecotricity.co.uk.

1.2 By submitting your competition entry you confirm that you are eligible to do so, and that you accept these competition terms and conditions. Please read these terms carefully. Your particular attention is drawn to clause 6 (Restrictions and Requirements) and clause 9.2 (Intellectual Property).

1.3 You do not need to include any of your personal details with your entry – shortlisted entrants will be contacted after the closing date via the email used to submit their entry, and asked to provide their name, postal address (including postcode), and telephone number. Shortlisted entrants who do not provide their contact details within 48 hours of being asked to do so will be disqualified.

1.4 The competition is free to enter.

1.5 You may only submit one entry to this competition. Entries over the maximum number of entries will be void.

1.6 Entries that do not comply with these terms and conditions will be void and will not be entered into this competition.

2 Start date

The competition will start at 9am on Friday 1 April 2022. Entries submitted prior to the start date will be void, and will not be entered into the competition

3 Closing date

The closing date for the competition will be 22 April 2022 at 11.59pm. Entries received by the promoter after this time will be void and will not be entered into the competition.

4 Selection of the winner

4.1 Two winners will be selected.

4.2 The winners of the competition will be the submissions chosen by a panel of judges (including one independent member) to be the best representations of nature’s energy out of all entries correctly submitted in accordance with these terms and conditions. The names of the judges are available on request.

5 Prize

5.1 The prize is a Lush Skincare Experience provided by Lush Ltd, consisting of the following prize elements:

5.1.1 An in-person one-to-one skincare consultation with a Lush staff member and an in-depth skincare routine discussion (max 30 minutes); and
5.1.2 A skincare product package to include three (3) full-sized products of either a facial or body care routine. The winning individuals can choose between either:
(a) a facial care routine including: a facial cleaner or fresh face mask; toner; and moisturiser, OR
(b) body care routine including: a soap or shower gel; body scrub or body conditioner; and body lotion or massage bar

5.2 The following conditions apply to the prizes:

5.2.1 Prize winners will be able to select their most convenient Lush store from any of the current stores in Great Britain (England, Scotland, and Wales only). Online consultations are possible if the winner is too remote to attend in person or cannot travel for any reason.
5.2.2 Each prize excludes all costs and expenses incurred by the winner that are not expressly set out in the description of the Prize package set out above, including without limit: (i) transportation; (ii) food and beverages; (iii) overnight accommodation; (iv) travel and medical insurance and any other required travel documents; (v) COVID-19 testing; (vi) any discretionary spending; and (vii) any related taxes.
5.2.3 All elements of the prize must be used in the same itinerary. The winner is not entitled to receive any unused portion or element of the prize.
5.2.4 The winner is responsible for ensuring that the winner is able to attend their appointment at the agreed time on the relevant date (to be arranged with the relevant Lush shop, after winners are announced). No alternative times and dates are available. The winner is solely responsible for making all travel and other arrangements necessary to attend their appointment.
5.2.5 Prizes are non-transferable, non-refundable, non-exchangeable and no cash alternative is available.
5.2.6 The winner must comply fully with all applicable laws and with the terms and conditions (including health and safety requirements) applicable to the prize. The promoters will have no liability to the winner if the winner is unable to receive the full benefit of the prize or is denied entry to, or is asked to leave, the store as a result of a failure to abide by such terms, any applicable law or as a result of inappropriate behaviour. In particular, it is the sole responsibility of the winner to familiarise themselves with any applicable COVID-19 requirements and protocols that may be in force from time to time.

6 Restrictions and requirements

6.1 Please note the following restrictions and requirements apply:
6.1.1 The competition is open to residents of Great Britain only. Entries from Northern Ireland cannot be accepted;
6.1.2 You must be over 18 to enter the competition;
6.1.3 Your photograph entry must not feature any identifiable person;
6.1.4 Your submission must not feature any third party’s branding or intellectual property rights;
6.1.5 Your entry must be your own work, and you may be asked to evidence that it is your own work;
6.1.6 Submissions must not be, or contain any material which is or may reasonably be considered to be, threatening, defamatory, obscene, indecent, offensive, pornographic, abusive, liable to incite racial hatred, discriminatory, menacing, inflammatory, in breach of confidence or otherwise unlawful;
6.1.7 Employees of the promoter and their immediate families are ineligible to enter this promotion.

6.2 You do not need to be a professional photographer to enter the competition.

7 Notification of the results and receipt of the prize

7.1 The promoter will notify the winners by email on or before Friday 20 May 2022.

7.2 The winner must complete their consultation prize within one (1) year following the end of the Entry Period.

8 Publicity and personal information

8.1 The promoter will use your personal information only in accordance with these terms and conditions.

8.2 The names and contact details of the winners will be passed to Lush Ltd in order that they can contact the winners to organise their receipt of the prize.

8.3 The surname and county of the winner will be published via Ecotricity Group Limited and Lush Ltd’s respective social media platforms from 20 May 2022.

8.4 You acknowledge that you may be asked to participate in publicity if you are selected as a winner.

9 General

9.1 This promotion is operated by Ecotricity Group Limited, in collaboration with Lush Ltd, the providers of the prize.

9.2 Copyright in your submission will be owned by you. You grant each of Ecotricity Group Limited and Lush Ltd a royalty-free, worldwide, non-exclusive, perpetual and irrevocable licence to use or reproduce your submission or any part of it for the sole purpose of further promotion of the competition, announcing the winners or future photography competitions with Lush Ltd.

9.3 While nothing in these terms and conditions will limit the promoter’s liability for death or personal injury caused by its negligence or for fraud, the promoter will not be legally responsible to entrants or winners for any losses that were not foreseeable to the promoter or to the entrant at the time of entry to the promotion or which are caused by a third party.

9.4 The laws of England and Wales apply to these terms and conditions.

9.5 Any disputes will be subject to the non-exclusive jurisdiction of the courts of England and Wales. This means that you can choose whether to bring a claim in the courts of England and Wales or in the courts of another part of the UK in which you live.
